I am shocked that Derek and his uncle came on this forum and lied about what happened. :eek:

Here is what will happen next - Derek won't do his community service. Derek won't travel all the way back to Las Vega$ for his court on November 28th. Derek will say that his wife's cousin's uncle's brother was very sick and he was helping him during this time so he couldn't do what the court ordered or travel back to Las Vega$. Derek will act as he is the victim once again. A warrant will be put out for Derek and he will be pulled over for speeding on the way to church six months from now and go back to jail.


Except they won't serve a out of state warrant for a misdemeanor.
 
I was a public defender when I got out of law school for a few years. I heard alot of interesting defendant stories. .

So Dave, what is your take on this?

I know that if the DA stuck with the felony charge and, if convicted, Derek Savoie would have faced a minimum of 1 year in Clark County. Obviously, no one knew if he had prior convictions or not. My guess is that the DA cut him a deal for a firsttime offender? Changed the charge to, perhaps, a petty/misdemeanor theft or disorderly persons?

I seriously had my doubts that this was his rodeo in court.

That and I don't know any church going Christians that make threats of bodily harm to others. No matter what type of situation they may find themselves in.
 
The DA reduced the charge down to a misdemeanor, a restitution fine that Mr. Savoie will have to pay to me and 40 hours community service.

I am appalled at the fact that the DA never contacted me, never consulted with me.

I am new at this and not sure if I have any rights, but I would certainly try to explore to see if any of my rights were violated.

The November 28th court date is the date where Mr. Savoie has to appear in front of the court and prove to the court that he has fulfilled whatever the sentences that the court handed down. I don't know the legal terminologies, perhaps someone in this field can chime in.

This is a very common plea deal for first time offenders or in cases where there are evidentiary issues. Seeing as you say you have him on video, walking with the cues, my guess has to be that he was offered this due to his lack of prior record and not to problems with securing a conviction from the evidence.

In non violent crimes, especially where the victim has been made whole again via recovery of stolen property, it is commonplace to see Judges and prosecutors resolve those cases without consulting with the victims. I realize this leaves a bad taste in your mouth but consider that to these cogs in the justice system wheel, this case is one of many where there are asked to either dedicate resources towards a trial or plea the case down to a mm and its resolved with a criminal conviction of theft on the defendants record. Think about it, if they had offered him 9 mos in jail to plea, he would have plead not guilty, bonded out and this would be a likely trial. Defendants who are offered sentences that are in upper reaches of where they would get the same sentence were they convicted at trial have nothing to lose by going to trial. To the Judge and prosecutor, they would rather dedicate the resources towards putting violent repeat offenders in prison.

As far as your rights as a victim, one thing you can do is call the prosecutor and ask that the defendant be adjudicated guilty of the mm theft charges. In many states an adjudication of guilt will be discoverable on background checks and is asked on job applications. Getting his record sealed and expunged on an adjudication of guilt is also much harder than if he is given a withhold adjudication of guilt.

Michael, are you upset because the DA didn't consult with you before the plea. What would you have said to try to have them change the plea to something more harsh?
I doubt that it would have done any good. The good thing is that he has been outed on this site and he will have a hard time showing his face in anything major, at least for a while.
I was at your booth in Vegas and can say that your guys had some real nice stuff there.
 
The plea bargain punishment was light yes. But getting banished from the sport you love and getting exposed on Facebook in front of all your family and friends is sweet justice and a lesson a lot of would be cue thieves can learn from this thread.

Very good post, he mite of skipped jail, but he cant skip the embarrasment that he deserves from fellow man, but like anything else it will die down as other things happen in our worlds, and we all will slowly forget about what this idiot had did, hopefully he will be band forever here, we dont need liars around anyhow, iam glad MIKE (cue man)came on here and set the story straight, now with out a doubt, Derek is a POS!

Sad but true...I said all along that this POS thief would never see jail time, and I was right. Like others have said, at least he's been outed in his local pool community, and here on AzB. Go back to post 85. I am sorry I was right. But I have personal stood in court and watched this crap over and over and over. The jail space is needed for more hardened scum. Remember guys if he goes to jail WE the taxpayers have to pay for him to be there. And to whom ever said he could be extradited and sent to jail in vegas.....the only way that happens is if he goes to nv and gets caught or pulled over by a nv police officer. Lots of guys running from child support in other states and even worse crimes.

Actually, it sounds like this was the perfect solution from the perspective of the Nevada justice system. They resolve it with a minimum of expense while at the same time seeing to it that he will likely stay the hell out of Nevada.
